Terms of Service

1. Acceptance of Terms

By accessing or using ModsMarketplace, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the site.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the security of your account.

3. Accounts

You must provide accurate information when registering and keep it current. You may not share, sell or transfer your account. You are responsible for all activity under your account.

4. Listings

Sellers are solely responsible for the accuracy, legality and ownership of their listings. ModsMarketplace does not take possession of items and is not a party to transactions between buyers and sellers. See our Seller Policies.

5. Fees

ModsMarketplace may charge fees as described in our Seller Fees policy. During Beta, fees are not finalized and are not charged unless explicitly communicated. We will disclose any fee before it applies.

6. Transactions

Transactions occur between buyers and sellers. ModsMarketplace facilitates listings, messaging, verification and (where available) payment processing. Buyer-protection and held-payment features are being introduced progressively; any not yet active are labeled “Coming Soon.”

7. Verification

Verification badges reflect specific, documented checks and do not constitute a guarantee. Seller verification confirms account details; listing verification confirms specific item attributes. See our verification information for what each badge covers.

8. Prohibited Conduct

• Listing counterfeit or stolen property.
• Misrepresenting condition, fitment, authenticity or ownership.
• Directing transactions off-platform or requesting off-platform payment.
• Harassment, fraud, spam or abusive communication.
• Attempting to circumvent fees or platform safety controls.

9. Intellectual Property

You retain ownership of content you submit but grant ModsMarketplace a license to display it in connection with the service. You must not infringe the intellectual property or trademarks of BMW or any third party. “BMW” and model designations are trademarks of their respective owners and are used here for fitment identification only.

10. Disclaimers

The service is provided “as is.” ModsMarketplace does not guarantee that every listing is accurate, authentic or fit for a particular vehicle. Fitment information is partly seller-provided and must be independently confirmed. We do not warrant uninterrupted or error-free service.

11. Limitation of Liability

To the maximum extent permitted by law, ModsMarketplace is not liable for indirect, incidental or consequential damages, or for losses arising from transactions between users beyond the scope of any protections explicitly provided by an active, completed feature.

12. Governing Law

These terms are governed by the laws of the jurisdiction in which ModsMarketplace operates, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction unless we offer an alternative dispute process.

13. Changes to These Terms

We may update these terms. Material changes will be posted here with an updated date. Continued use after changes constitutes acceptance.
